Terms of Use
This document is a translation of the Japanese version. If there is any difference between the Japanese version and this translation, the Japanese version prevails.
Article 1 (Application)
These terms set out the conditions for using "Uchi no Genba no Kotoba" (the "Service") provided by SBGG LLC (合同会社SBGG) (the "Company").
Article 2 (Service agreement)
The service agreement is formed when a host company (the "Contractor") applies by the method specified by the Company and the Company accepts the application. New Contractors can try the Service free of charge for 14 days.
Article 3 (Fees)
Fees are as stated in the Notice under the Specified Commercial Transactions Act. The number of billed people is the number of learners who have not been deactivated.
Article 4 (Learner consent)
Learning records are stored only when the learner has personally consented. Sharing with organizations outside the company and use for creating industry benchmarks are limited to cases where the learner has personally consented to each. The Contractor cannot give consent on behalf of learners.
Article 5 (Participation in creating industry benchmarks)
The Contractor can choose on the settings screen whether to participate in creating industry benchmarks. Even when participating, only records of people who have consented are used for benchmarks, and they are shown only when records from 5 or more companies are available, in a form that does not reveal which company or person they belong to.
Article 6 (Integration)
The Contractor may, at its own discretion, issue integration keys to integration partners. Only information on learners who have consented to sharing, within the scope of the key, is passed to integration partners.
Article 7 (Checking of translations)
Translations in the Service are shown after a draft translation by AI has been checked by a reviewer who is a native speaker of that language. Words related to safety are not shown to learners until the check is complete.
Article 8 (Prohibited acts)
The Contractor must not enter information such as residence card numbers, passport numbers or residence status into the Service.
Article 9 (Data export and deletion)
The Contractor can export its own data at any time. When 90 days have passed since cancellation, the Company deletes all of the Contractor's data.
Article 10 (Disclaimer)
The Company does not guarantee that the translations in the Service will be correctly understood in every situation at the workplace. Please verify safety instructions in practice at the workplace.
Article 11 (Governing law and jurisdiction)
These terms are governed by Japanese law, and the Tokyo District Court shall be the exclusive agreed court of first instance for any dispute relating to the Service.
Article 12 (Service for businesses only)
The Service is intended only for corporations and organizations that use it for business purposes (including host companies as well as sending organizations, Japanese language schools and similar organizations outside Japan). Consumers (individuals) cannot enter into a contract. Fees for Contractors outside Japan are billed in US dollars.
Article 13 (Taxes)
Listed prices exclude all taxes imposed in the Contractor's country or region (including value-added tax, goods and services tax and withholding taxes, such as the Vietnamese foreign contractor tax and Indonesian VAT (PPN) and Article 26 income tax withholding (PPh 26)); such taxes are borne by the Contractor. If the Contractor is required by law to withhold any tax from a payment, the Contractor shall pay such additional amount as is necessary for the Company to receive the full listed price after the withholding (gross-up). Upon request, the Company will provide a Japanese certificate of tax residence to support relief under an applicable tax treaty. Japanese consumption tax does not apply to services provided to Contractors outside Japan.
